The owner of three adjacent properties 94 Main Street/18 Hueston Street (PID# 90196718); 90 Main Street/16 Hueston Street (PID# 90196726; and 88 Main Street/14 Hueston Street (PID# 90196734) applied to enter into a Development Agreement (Attachment 1) to allow for a maximum of two (2) Short-term Rentals (STR) per lot for a total of six (6) STRs. The Municipal Planning Strategy (MPS) and Land Use By-law (LUB) have been recently amended to regulate and permit short-term rental accommodations subject to specific conditions.

The amended LUB allows a maximum of one short-term rental per lot where the short-term rental host resides on-site (as-of-right). However, situations where more than one short-term rental unit is desired and/or where the short-term rental host does not reside on-site, may only be permitted on a case-by-case basis by Development Agreement with consideration to the criteria outlined in the MPS (see Section 3 below).

Short-term Rentals are allowed in all residential, mixed-use, and commercial zones where a dwelling unit is a permitted use. As of the 2021 Census, there were just under 3,600 private dwellings[1] in the Town of Yarmouth. Although additional research is necessary, based on data currently available it would appear that less than two per cent of the total number of units in Yarmouth have been used and potentially are being used as short-term rentals. STRs requested through this application are included within the above noted two per cent estimate.

[1] Total Private Dwellings – 2021 Census - Private dwelling refers to a separate set of living quarters with a private entrance either from outside the building or from a common hall, lobby, vestibule or stairway inside the building. The entrance to the dwelling must be one that can be used without passing through the living quarters of some other person or group of persons.

    A Public Hearing will be held on Thursday, February 13th, at 6:30 pm in council chambers, at 400 Main Street. Members of the public can attend and speak at the hearing, or hand in written submissions. Written submissions can be emailed to admin@townofyarmouth.ca, or delivered to Town Hall, and must be received by 12 pm (noon) on February 10th, 2025.

    What is the Hearing About?

    This Public Hearing will address the following items:

    1. Proposed Development Agreement for 88, 90 & 94 Main Street and 14, 16 & 18 Hueston Street

    The owner of 88, 90 & 94 Main Street and 14, 16 & 18 Hueston Street (PID#'s 90196734, 90196726 & 90196718) applied to enter into a Development Agreement to formally recognize and allow for six short-term rental units. Council has approved to move forward with a Public Hearing prior to consideration of the requested Development Agreement.

    2. Proposed Development Agreement for 1 Jenkins Street

    The owner of 1 Jenkins Street (PID#90195066) applied to enter into a Development Agreement to formally recognize and allow for five (5) existing short-term rental units. Council has approved to move forward with a Public Hearing prior to consideration of the requested Development Agreement.

    3. Proposed Development Agreement for 25 Willow Street

    The owner of 25 Willow Street (PID#90207861) applied to enter into a Development Agreement to allow for two (2) short-term rental units. Council has approved to move forward with a Public Hearing prior to consideration of the requested Development Agreement.
