Consultation has concluded

On February 5, 2024, the owner of a property located at 468 Main Street applied to allow for three (3) short-term rentals on their lot (PID#90195967) developed with a mixed-use building. The Municipal Planning Strategy (MPS) and Land Use By-law (LUB) have been recently amended to permit short-term rental accommodations.

The amended LUB allows a maximum of one (1) short-term rental per lot where the short-term rental host resides on-site (as-of-right). However, in situations where more than one (1) short-term rental unit is desired and/or where the short-term rental host does not reside on-site, may only be permitted on a case-by-case basis by Development Agreement with consideration to the criteria outlined in the MPS.

The lot is located on the west side of Main Street between Chester Street and Fifth Street as shown in Attachment 2. The lot is approximately 4,000 square feet in size with approximate dimensions of 12 by 32 metres. The property is developed with a two-storey mixed-use building approved for a restaurant and one (1) dwelling unit. There is a separate two-storey building at the rear of the lot. Access is available from Main Street with one (1) parking stall available in the garage.

The applicant indicated their intent to convert the existing single dwelling unit located on the second floor of the main building into two (2) separate units. In addition, a third unit may be created by converting some of the existing floor space within the smaller building at the rear of the lot. Conceptual floor plans are included in Attachment 3. Subject to Council decision on this application, Development Permit and Building Permit applications would be required.

    A Public Hearing will be held on Thursday, July 11th, 2024 at 6:30 pm in Council chambers, located at 400 Main Street. Members of the public can attend and speak at the hearing, or hand in written submissions. Written submissions can be emailed to admin@townofyarmouth.ca, or delivered to town hall, and must be received by 12 pm (noon) on July 8th, 2024.

    The owner of 468 Main Street (PID# 90195967) applied to enter into a Development Agreement to accommodate three (3) short-term rental units within a mixed-use building located at 468 Main Street. Council has approved to move forward with a Public Hearing prior to consideration of entering into the requested Development Agreement with the landowner.
