Consultation has concluded

On February 5, 2024, the owner of 239 Forest Street applied to enter into a Development Agreement to permit a new accessory building on their lot. Currently, the Town of Yarmouth Land Use Bylaw (LUB) does not allow for accessory buildings within front yards except for situations where access to the side or rear of lots is not practical or adequate. Given the unique subdivision and development history of the subject lot (239 Forest Street), this LUB requirement prevents otherwise typically acceptable placement of an accessory building.

If approved by Council, the proposed Development Agreement would provide the landowner with additional and appropriate, development flexibility that would allow for the intended accessory building to be constructed in the front yard of the lot as generally shown in Schedule B of the draft agreement.

    This is to serve notice that the Council of the Town of Yarmouth, at its meeting on Thursday, May 16th, 2024 at 6:30 pm, approved the following:

    Proposed Development Agreement for 239 Forest Street

    The Development Agreement is intended to permit a new accessory building within the front yard of the lot located at 239 Forest Street. For additional information, contact the Town Planner at 902-742-1505

    14 Day Appeal Period

    Appeal may be made to the Nova Scotia Utility and Review Board within fourteen days (14) of the publication of this notice. Any aggrieved person, the Provincial Director of Planning or Council of an adjoining Municipality may, within the prescribed appeal period, appeal the decision of Council to the Nova Scotia Utility and Review Board in accordance with the Municipal Government Act.

    A Public Hearing will be held on Thursday, May 16th, 2024 at 6:30 pm in Council Chambers, located at 400 Main Street. Members of the public can attend and speak at the hearing, or hand in written submissions. Written submissions can be emailed to admin@townofyarmouth.ca, or delivered to Town Hall, and must be received by 12 pm (noon) on May 14th, 2024.
